The rules, rights and conditions for using Matchtopia. Please read them before you use it.

Acceptance of Terms
By creating an account, accessing, or using Matchtopia, you agree to be bound by these Terms of Use, our Privacy Policy, and any safety, community, or purchase rules made available in the Service. If you do not agree, you must not access or use Matchtopia.

Eligibility and Representations
You represent and warrant that you are at least 18 years old, legally capable of entering a binding contract, and not prohibited by law from using this type of service. You agree to provide accurate, current information and to keep it updated.

Account Registration and Security
You are responsible for all activity under your account and for maintaining the confidentiality of your credentials. You may not share your account, create multiple deceptive accounts, or access another person's account without authorization.

License Granted by Matchtopia
Subject to your compliance with these Terms, Matchtopia grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended dating and communication purposes.

Your Content and License to Matchtopia
You retain ownership of content you submit, including profile text, photos, and messages ("Your Content"). You grant Matchtopia a worldwide, royalty-free license to host, store, reproduce, adapt, display, distribute, and otherwise process Your Content to operate, secure, improve, and support the Service, including moderation, abuse prevention, and feature development.

Content Standards and Moderation
You may not post unlawful, infringing, deceptive, exploitative, harassing, hateful, or sexually explicit prohibited content, or content that exposes another person's private information. We may review, remove, restrict, or preserve content and account data in our sole discretion for safety, legal compliance, or enforcement.

Prohibited Conduct
You agree not to stalk, threaten, defraud, spam, impersonate, scrape, reverse engineer, disrupt, or interfere with Matchtopia. You may not use unauthorized automation, bots, scripts, API access, or data extraction tools, and you may not use the Service for commercial solicitation, money requests, or unlawful activity.

Safety and User Interactions
You are solely responsible for your interactions with other users, including off-platform communications and in-person meetings. Matchtopia does not guarantee user identity, intentions, or conduct and does not guarantee criminal background or identity verification for every user at all times.

Data Use and Sensitive Information
The Service processes personal and potentially sensitive data, including account identifiers, age and birthday, gender and gender preferences, profile data, photos, message content, location coordinates, interests, relationship goals, and authentication or device/session signals such as access and refresh token records. Optional sensitive features require their own in-product disclosures and controls in addition to these general Terms. By using Matchtopia, you acknowledge this processing as described in our Privacy Policy.

Optional Naughty Desire Deck
Naughty Mode is an optional adults-only feature. If you explicitly opt in, Matchtopia stores your selected turn-ons privately and uses them to find Naughty matches. Answers to the optional guided questionnaire stay only in the open quiz and are not uploaded, logged, analyzed, or retained; only cards you explicitly add and save enter your private Desire Deck. Unmatched choices are not placed on public or general profiles and are not revealed to a match; only mutual shared or complementary connection signals may appear in an immutable match-time report. You can pause future Naughty matching while keeping your deck, or withdraw consent and delete the deck, its selections, and Naughty reports involving you. Deleting the deck does not delete existing matches or chats. A match indicates shared curiosity, not consent to any activity.

Matching, Ranking, and Automated Processing
Matchtopia uses algorithmic and automated systems to rank, recommend, and generate matches, including profile similarity models, location signals, activity signals, conversation-pattern analytics, optional astrology dimensions, Persona preferences, and private mutual Naughty signals. Naughty tiers control presentation intensity and are not compatibility percentages or psychological claims. These systems may produce outcomes you disagree with. Matchtopia does not guarantee any specific match or relationship outcome.

Profile Image Processing and Progressive Reveal
By uploading images, you authorize Matchtopia to store originals and processed variants (including resized and blurred versions) and to display images based on relationship and interaction context. Image visibility and reveal mechanics may change over time to support product design, privacy, and safety controls.

Messaging and Communications
Matchtopia provides in-app messaging and real-time communication features, including typing indicators and delivery/read state mechanics. You consent to the technical processing required to provide these features and acknowledge that transmission timing and availability may vary by network and platform conditions.

Points, Digital Features, and Purchases
Matchtopia may provide points-based match generation, coins, digital features, virtual items, or cosmetic inventory. Coins and other virtual items are licensed, not sold, are non-transferable, have no cash value, cannot be redeemed for money or transferred outside Matchtopia, and may only be used inside the Service. Coin balances are account-wide, but coins are not property and may be modified, suspended, or discontinued where permitted by law. Real-money coin purchases are handled through Apple App Store or Google Play in-app purchases on mobile and Stripe Checkout on web. Refunds or charge handling are governed by the applicable store, payment processor, platform rules, and law.

Third-Party Services
Matchtopia may rely on third-party infrastructure and service providers, including app stores, payment processors, cloud infrastructure, email delivery, AI/model tooling, and image processing systems. Matchtopia is not responsible for third-party outages, terms, or independent actions outside Matchtopia's reasonable control.

Account Suspension and Termination
You may stop using the Service or request account deletion at any time. We may suspend, restrict, or terminate accounts immediately where we reasonably believe there is a Terms violation, safety risk, fraud, abuse, or legal obligation to act. Certain records may be retained as required for legal, security, fraud-prevention, and backup integrity purposes.

Disclaimers
The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Limitation of Liability
To the fullest extent allowed by law, Matchtopia is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising out of or relating to your use of the Service. Where liability cannot be fully excluded, our aggregate liability is limited to the greater of amounts paid by you to Matchtopia in the twelve months before the claim or USD 100.

Indemnification
You agree to indemnify, defend, and hold harmless Matchtopia and its affiliates, officers, employees, and service providers from claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of Your Content, your misuse of the Service, or your violation of these Terms or applicable law.

Dispute Resolution; Arbitration; Class Action Waiver
To the fullest extent permitted by law, you and Matchtopia agree to first attempt informal resolution of disputes. If unresolved, disputes will be resolved by binding individual arbitration rather than court, except where prohibited by law or where small claims court is available. You and Matchtopia waive class, collective, representative, and jury-trial rights to the extent permitted by law.

Governing Law
Except where mandatory local consumer law requires otherwise, these Terms and all disputes arising from them are governed by the laws of the State of California, U.S.A., without regard to conflict-of-law rules.

Changes to Terms
Matchtopia may modify these Terms from time to time. Material changes will be communicated by posting updated Terms in the app and updating the "Last updated" date. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of those changes.
